Terms of Service

Let’s keep this clear and simple.

Kurtopia and its management are not responsible for your actions or the actions of others in our domain.

We are not liable for loss of assets due to grid failure or act of Grid Gods.

We expect our residents and visitors to keep all activities legal and consensual.

Bullying, harassment, or unacceptable behavior is not acceptable.

We reserve the right to restrict access or ban those found not to comply with the Terms of Service or the spirit of our community.

We reserve the right to amend these ToS at any time.

Now for the fine print.

Terms of Service
Your access to and use of Kurtopia is based on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Digital Rights Management (DRM) in OpenSimulator
You acknowledge the use of Digital Rights Management in OpenSimulator that grants certain content licenses to other users through the permissions system. This may include the copy, modify, and transfer settings for indicating how other users may use, reproduce, distribute, prepare derivative works of, display, or perform your Content subject to choices you make. You agree to respect, follow and allow the DRM rights of others that use this system.
 
You acknowledge that content creators maintain their rights to their content. You accept full responsibility for use of provided content and remain liable for unlawful usage.

Content Ownership and Licensing
You retain ownership of all content you create and upload to Kurtopia. By using the Service, you grant Kurtopia a limited, non‑exclusive, worldwide license to store, transmit, display, and reproduce your content solely for the purpose of operating and maintaining the Service.
You represent and warrant that you have the necessary rights to all content you upload, and that such content does not infringe the rights of any third party.


DMCA Notices
If a content provider reports a DMCA violation to Kurtopia, it will be investigated and if warranted, removed from public access. Offending accounts may be banned from use of the services.


Copyrights
You agree that you will not copy, transfer, or distribute outside of Kurtopia any content in whole or in part or in modified or unmodified form, that infringes or violates any Intellectual Property Rights of Kurtopia , other Content Providers, or any third parties.


Age Requirement
You certify that by using this service you are over 18 years of age.


Data Rights
You grant Kurtopia permission to process your data to maintain your account.

This includes:
Registration information you provide when creating an account such as:

  • Your Email address (if we ask for it in the registration process)
  • Your Avatar Name
  • Your IP address
  • Information necessary to connect to your PC such as session ID’s and web cookies
  • Any other personal information you give us to service your account.

Transaction information you provide when you request information or purchase a product or service from us, whether on our sites or through our applications.

Kurtopia processes only the minimum data required to operate the Service. You acknowledge that certain technical identifiers may be transmitted to external systems as part of normal grid operation.


Hyperlinks and Hypergrid Travel
Kurtopia may contain links or hyperlinks to third-party services that are not owned or controlled by Kurtopia. Hyperlinks are destinations that you may travel to. Hyperlinks connect to third parties, and they will have access to limited data. They will need this info to provide Hypergrid service, and may not follow the GDPR act, but may use this information by means outside of our control.

You agree that your Avatar Name, Session ID, IP address and other technical information can be sent to other opensim grids when you travel the hypergrid.

Kurtopia has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.


User Conduct and Content
All users are expected to comply with applicable local, national, and international laws regarding online conduct and acceptable content. This includes, but is not limited to, laws regulating the possession and distribution of images and other content.

Users are strictly prohibited from uploading, sharing, or distributing illegal images or content through our services. This includes, but is not limited to, images or content that violate copyright laws, depict illegal activities, or contain explicit or offensive material.

Any account found to contain illegal images or content will be subject to immediate suspension or termination, without notice. We reserve the right to report any illegal activity to the appropriate authorities.

Users are responsible for all content posted and activity that occurs under their account. Users are required to report any illegal images or content they encounter to us immediately.

Community Standards
Users must not engage in:

  • Harassment, stalking, griefing, or targeted disruption of other users.
  • Impersonation of staff or other users.
  • Attempts to bypass DRM, permissions, or security systems.
  • Interference with the operation of the grid or its services.

Kurtopia reserves the right to take action against any conduct that disrupts the community or threatens the safety, stability, or integrity of the Service.

Rental Land
Users who obtain or occupy Rental Land within Kurtopia acknowledge that all activities, builds, scripts, and content placed on such land remain fully subject to the User Conduct and Content provisions of these Terms of Service. Rental Land is provided strictly on an “as‑is” and “as‑available” basis. Kurtopia shall not be responsible or liable for any loss, interruption, damage, or claim arising from the use, misuse, availability, or performance of Rental Land, consistent with the limitations set out in the Liability clause.

All Rental Land fees are treated solely as voluntary donations or contributions toward the operational costs of maintaining the Kurtopia grid. These contributions do not constitute payment for commercial services, do not create a business relationship, and must not be interpreted as revenue, profit, or consideration for trade or commerce. Kurtopia operates exclusively as a non‑profit virtual community, and all contributions support the sustainability of the grid.

Service Availability
Kurtopia is provided without any guarantee of uptime, performance, or data persistence. Region crashes, asset loss, inventory corruption, or service interruptions may occur.
Kurtopia does not guarantee:

  • Continuous or error‑free operation
  • Recovery of lost assets, inventory, or regions
  • Availability of any specific feature or region

Users agree that the Service may experience outages or data loss without compensation or liability.

Liability
Kurtopia shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any websites or services.
This limitation applies to all aspects of the Service, including but not limited to user content, hypergrid travel, Rental Land, and third‑party interactions.


Right to be forgotten
You have the right to request erasure of personal identifying information, or to the deletion of your account. Kurtopia may retain certain records that are required to be retained by law.

Changes to the Service
Kurtopia may add, modify, or remove features, regions, or services at any time. Users are not entitled to compensation for such changes.

Dispute Resolution
Disputes between users and Kurtopia will be handled informally whenever possible. Kurtopia’s decisions regarding in‑world disputes, region management, or enforcement actions are final.

Kurtopia is not responsible for disputes between users.


Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms, security concerns, illegal activity, or interference with the operation of the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

This Agreement may be modified at any time by posting the revised Agreement here. If at any time you do not agree to these Terms, you must immediately cease your use of the system.

Agreement
You give Kurtopia permission to collect and use your data as indicated in this Policy, and you agree to be bound by these Terms of Service.
